What is a copyright?

A copyright provides protection against illegal copying, theft or plagiarism of your work! While owning a copyright is automatic under U. S. copyright law, in order to enforce your rights you must register your copyrights with the U. S. Copyright Office!

How do I get a copyright?
The good news is that you automatically own a copyright when you create an original work... such as a book, a play, a blog, a photograph or artwork.  While not mandatory, it is good practice to give notice of your copyright.  You do this by placing a copyright notice on your work, such as:

What is my benefit of U. S. Copyright Office registration?
While you may own a copyright, you cannot enforce the copyright unless you register!   This means that if some copies your work or plagiarizes your work, you cannot sue them unless you have previously registered your copyrights!

To sue an infringer to enforce your copyrights, you must register within 3-months of publication or before publication and before any infringement occurs, in order to gain maximum copyright protection... and claim up to $150,000 in statutory damages plus attorney fees for any infringement.

Does a copyright protect my work in other countries?
While no creative work is automatically protected worldwide, there are international treaties which provide protection automatically for all creative works as soon as they are fixed in a medium. There are two primary international copyright agreements, the Buenos Aires Convention and the Berne Convention.

Can a copyright be owned by my company or organization?
Yes.  The owner - also known as a Claimant - may be your company, if you are an employee of the company or created the work under a 'work-for-hire' agreement, or transfer your rights to a company.

Do 3rd party manuscript uploads protect my copyrights?

Why can't I just use government forms or e-filing system?
You can... however, this is a complex process requiring much more time to learn and properly prepare.  You do not receive an e-mail confirmation of your registration... and your work doesn't get reviewed for several months.  Also, the e-filing system is not compatible with many mobile devices.

The U. S. Copyright Office e-filing system has occasional outages which may cause delays, potential loss of data or reliability issues.
